  <dc:description xmlns:ns0="xml" ns0:lang="en">Today’s increasingly co-operative relations between the state and private persons  have brought numerous new problems to the law. It may even be held that the new  types of ‘co-operationism’ between the state and private persons has plunged the law  into deep crisis. This is because by freeing the administration from the constraints  which are binding by statute on the one hand, and transferring competences hitherto  incumbent on government for the upholding of public interests to private entities on  the other, the basic pillars of democracy under rule of law are called into question.  This can be illustrated very clearly by the example of Decision 109 Ib 146 (1983) of  the Swiss Federal Court on the Agreement on the Swiss banks’ code of conduct with  regard to the exercise of due diligence. But this is not all: Decision 109 Ib 146 also  indicates that the problem of co-operationism may be closely connected with another  new sort of phenomenon which is increasingly irritating the law: the organisational  form of the network.</dc:description>
  <dc:description xmlns:ns1="xml" ns1:lang="de">Die heute zunehmend kooperativen Beziehungen zwischen Staat und Privaten  zeichnen sich durch zahlreiche neue rechtliche Problemstellungen aus; es kann sogar  behauptet werden, der neue Kooperatismus zwischen Staat und Privaten habe das  Recht in eine tiefe Krise gestürzt: Denn indem dieser Kooperatismus einerseits die  Verwaltung von den Fesseln der Gesetzesbindung befreit und andererseits Privaten  Kompetenzen überträgt, die bisher der staatlichen Verwaltung zur Wahrung  öffentlicher Interessen oblagen, werden die Grundpfeiler der rechtsstaatlichen  Demokratie in Frage gestellt. Dies lässt sich anhand des Entscheids des  schweizerischen Bundesgerichts 109 Ib 146 (1983) zur Vereinbarung über die  Sorgfaltspflicht der schweizerischen Banken (VSB) mit aller Deutlichkeit zeigen. Aber  nicht nur das: BGE 109 Ib 146 signalisiert auch, dass das Problem von Kooperationen  zwischen Staat und Privaten eng mit einer anderen neuartigen Erscheinung  verbunden sein kann, die das Recht in zunehmendem Maß irritiert: der  Organisationsform des Netzwerks.</dc:description>
